According to Jonce Chidester, Dunklin County assistant prosecuting attorney, a motion for the continuance was made upon the grounds that the witness for the state was unavailable.
Jarrett made an objection to the continuance of the case but the motion was sustained by Judge Preyer.
Original charges filed against Jarrett consisted of two counts which included forcible rape and statutory sodomy in the first degree which stems from an incident involving a minor female. The latest charge brought against Jarrett is statutory sodomy in the first degree against a different victim under the age of 14 years. The preliminary hearing that was scheduled for Thursday, Jan. 26, was in connection with this latest charge.
Each count against Jarrett is considered to be an unclassified felony each carrying a term of at least five years minimum with the maximum being a life sentence.
"Basically, the court can sentence to any number of years but it has to be at least five," Chidester said.
Jarrett was first arrested in May 2010 and bond was set at $100,000 cash only which was reduced to a $75,000 cash or surety bond.
On July 14, 2010, Jarrett entered a plea of not guilty with the court.
The case was approved for a change of venue to Butler County in August 2010, and in September 2010, Jarrett was able to post bond.
In October of 2011, another change of venue took place transferring the case from Butler County once again to Dunklin County with Judge John C. Spielman assigned to the case.
It was in this courtroom appearance on Oct. 14, when Jarrett and his former attorney Scott D. Dale of Poplar Bluff, Mo., filed a motion with the court for a change of judge which was granted by Judge Spielman. On November 18, 2011 Judge Preyer was assigned to the case and a hearing was scheduled for 9 a.m., Dec. 8, 2011, with Jarrett appearing with his attorney. It was at this hearing a date for the preliminary hearing was scheduled.
Along with the preliminary hearing a 491.075 hearing will also be conducted which will allow the state to use statements previously made by a person that was under the age of 14 years of age.
At press time, Jarrett remains free on bond.

I know in this country we are presumed innocent until proven guilty. But, in this case, when it concerns possible rape and sodomy of children....why is this person allowed to be out on bail??? So he can do it again? Something is not right with this at all.
think about this!Innocent until proven guilty!! would you want to be locked up for something your being accused of? This situation is hard enough without having people getting on web sites and making comments like this! You have to remember that these people have family and seeing this type of negativity only make things worse!! you never know when you will be in the family shoes. Please be respectfull and if you cant say any thing nice please say nothing at all! Its sad enough this is front page news every month for a year just about, so please dont add to the pain...
