Dangerous Dog Ordinance in effect
After several instances of pit bull dogs being inside the city limits of Kennett, including a occurrence in which local Human Officer Tina Petix wrote six tickets in one day, Kennett Mayor Roger Wheeler wants citizens to know that it is unlawful to possess a pit bull, or any other dangerous dog, within the city limits.
"One day that it warmed up [earlier this month], every corner I went around, [there were pit bulls] tied to their front porches. They had them sitting in a chair on their front porch," Petix said. "They were just everywhere."
Petix said as she went to write one ticket, she was checking to see if she had written the individual any previous tickets and discovered he had a warrant for failure to appear on two dangerous dog violations.
"A lot of my pit bull tickets, they do 'failure to appear' on," Petix said.
Petix said the fine for violating the dangerous dog ordinance is no less than $50 and up to $500, and the fine is levied on sight of the animal.
Petix said the ordinance is hard to enforce since she cannot take the animals.
"Even though it is illegal to possess, we can't go and pick them up without a warrant," Petix said, adding that if a dog is surrendered or taken via warrant, the owner can get the dog back if they show proof of residency outside the city limits.
Wheeler said he is trying to get the ordinance changed.
"I'm trying to get an ordinance that will allow the humane officer to impound and euthanize any vicious dog," Wheeler said.
The city's ordinance currently defines a dangerous dog as:
"1. Any dog which, according to the records of the appropriate authority, has inflicted severe injury on a human being without provocation on public or private property, or;
2. Any dog which, according to the records of the appropriate authority, has killed a domestic animal without provocation while off the owner's property, or;
3. Any dog owned or harbored primarily or in part for the purpose of dog fighting or any dog trained for fighting, or;
4. Any dog, not owned by a governmental or law enforcement unit, used primarily to guard public or private property, or;
5. Any dog with a know propensity, tendency or disposition to attack unprovoked, to cause injury, or to otherwise threaten the safety of human beings or domestic animals, or;
6. Any dog which, when provoked, chases or approaches a person upon the streets, sidewalks or any public or private property in a menacing fashion or apparent attitude of attack.
7. Any pit bull dog, 'pit bull dog' being defined to mean:
a. The bull terrier breed of dog;
b. The Staffordshire bull terrier breed of dog;
c. The American pit bull terrier breed of dog;
d. The American Staffordshire terrier breed of dog;
e. Dogs of mixed breed or other breeds than above listed which breed or mixed breed is known as pit bulls, pit bull dogs, or pit bull terrier, or;
f. Any dog which has the appearance and characteristics of being predominantly of the breeds of bull terrier, Staffordshire bull terrier, American pit bull terrier, American Staffordshire terrier, any other breed commonly known as pit bulls, pit bull dogs, or pit bull terriers; or a combination of any of these breeds."
Under Section 210.035 of the ordinance, it states, "No person shall possess, own, keep, harbor, allow to be upon in or upon his premises or otherwise have custody of a 'dangerous dog' within the city limits of the City of Kennett."
The people of Kennett need to understand that it is against the law to have a pit bull dog in the city of Kennett, period. We keep getting visit after visit after visit and people keep saying 'I didn't know that.'

Wish they worked that hard to get rid of the cats. They are everywhere, in your yard, on your vehicle, in your garage, etc. And they always spray their surroundings.
That is completely ridiculous. Why on earth would you want to put EVERY single APBT down? Not ALL of them are bad. What is next? Going to put inmates down too? This ordinance is completely unjustified. Not all APBT owners are ignorant when it comes to the breed. Before the ordinance passed, I raised them. I never once had one that was "vicious". Completely banning the breed from the city limits is a bit over the top I think. What about the people who love them as family pets? I guess they have to give up their rights. This aggravates me. Impound and euthanize any vicious dog? Come on now.
Just recently 2 family pet rottweilers viciously attacked and killed a girl under 6. No thanks.
So, Wheeler thinks we should euthanize dogs based solely on their breed. That's ridiculous.
Absolutely ridiculous! Has Kennett returned to the dark ages??? Dachsands should be on the list too -- they bite more children than most other dogs. The main thing Kennett needs is a SPAY/NEUTER ordinance. Punish the owner -- not the breed!
i disagree with most of the things mayor wheeler has proposed, EXCEPT, this...!! i agree that "some" are pets BUT..most are not..and i also think the "owner" should be punished, not only with a monetary fine, but maybe even jail time. I do agree with a SPAY/NEUTER ordinance, and it should be affordable for ALL people. AND EUTHANIZING SHOULD BE COMPLETELY OUT OF THE QUESTION, UNLESS THEY HAVE KILLED OR MAIMED ANOTHER ANIMAL OR PERSON. (honestly my chihuahua bit more people than all the other dogs i have ever owned put together)
kennett has gotten a little out of hand . more worried , about dogs ,but what about cats , a lady on your side of town has 18 running lose . the whole point having a dog is to let you know when something going on .we have mixed breeds its not our big ,its our 2 lb tea cup. i thank poeple needs to rethink this poeple loves there dogs . maybe prower does go to your head ....../!

Since I do have my freedom of speech and press.. In my opinion (notice my opinion)) Kennett mayor needs to get his stupid head out of his butt and actually do a good job with the town and worry about other things.. Isnt this the same mayor that had the fight or was drunk at the fair or carnival????
sj83: I wouldn't turn them into PETA, PETA won't do anything for pitbulls. They think the same way Kennett officials do about them. They think they should be demolished also. I heard a member of PETA say that American Pitbull Terriers are not ANIMALS. They are Demons. Haha!. I wonder how we could start a petition to get this stuff STOPPED? There's much more to worry about then a family owning a loving, loyal wiggle butt pitbull. It's a dang shame.

My friend has a pit and a 4 year old daughter and she'll hold onto her tail and the dog will pull her and they wrestle and play.
Its not the dog its the person. Maybe instead of worrying about the pits they should worry about these frequent jailhouse birds, they should be put down if they are in and out of jail a lot.

I find it funny that this so called ordience has been put into place but cannot be inforced. I agree that some of these dogs are great dogs and not all dogs should be punished. Those dogs that are the cause of injury to the point of death should be put down. But if a pet is safe and causes no problems then let them be. Maybe if the city spend more money catching people who are actually doing harm then maybe we would not have such a problem with drugs.
It is very commendable that Kennett has such an ordinance concerning pit bull dogs. The pit bull breed is a very bad breed of dog. In my opinion they should be outlawed every where with no exceptions.
I do believe that that is against your constitutional rights and its discrimination against pit bull owners seeing how they singled out no other breeds but pitbulls

One other thing Mayor Wheeler -- I don't think Kennett needs to lose any tax-paying citizens to other cities by making them move with their dogs.
Most of the people who consider them "bad breeds" has actually never owned one or been around one long enough to see the kind of love they give. These poor dogs have had a bad wrap for a long time. When do you ever see the GOOD things pits do? Never. Not that long ago, a Pitbull woke up his master laying in his bed because the house was on fire. This was somewhere in New York. Another Pitbull warned someone in the home that a 'stranger' had came up while her daughter was at play, and you know what?..the pitbull wasn't even her dog. it was loose. Yeah...ALL pitbulls are bad..give me a break.
ok here's an update.. I called and talked to Tina (the lady over the humane society) asking about the pit up there in the picture. she said the pic was almost a week old and that the owner surrendered it so they "sent' it to a rescue place to be adopted.. Here's the kicker.. I asked her where did they send it b/c something about the picture I am wanting the dog so bad. This is what the conversation said..
me : where did you send it?
tina: I cannot release that.
me: you cant tell me where the dog went?
Tina: no I cannot release that, the owner surrendered it..
me: ok so you cannot release the information where a dog was sent to be adopted out at public rescue centers?
tina; No I cannot.
me: ok well i'll call every center in the tri-state area... then i hung up!
No what happened i guarantee is the dog is DEAD! I called every center from caruthersville to blytheville, Dyersburg, Jonesboro, Paducah, St. Louis.. I guarantee you my cell phone has about 100 numbers on it where Ive looked up numbers through petfinder.com and google.. None of them have received this dog...
!!!!!!!!!!!!!!!! YOu would think if she liked animals and wanted them to go to homes, shed tell me that.. Our tax money is paying for all of the fees for these dogs anyway!!!! This is after I told her I dont live in Kennett!

To lamuntz: Kennett would be better off with law breakers moving out of town, To AA1981: in your statement you have born out that pit bulls do tresspass, and also such a thing as smoke detectors are a better warning about a fire. To sj83: The dog was probably dispatched with good riddence.

kennett makes up there own rules and passes
ordinances and then they just run a add in the paper and TELL people what they must do. No one gets to vote or express there opinion. Just the mayor and city council. Thats why i took my 3 pitbulls and moved away. Kennett makes me SICK .
I got my puppies when they were babies and have raised them in the house with my children and let my granchild sleep in the bed with me and my pitbull.... My dodg means the world to me . Kennett likes to murder dogs even if they have not bothered anyone. I applaude the person that is stepping up and contacting someone to defend the poor innocent animals and speaking for them since they get no vioce. thank you

first of all, sj83, caruthersville is not a rescue for pits, it is an animal shelter. a pit rescue deals only with pits. the privacy act prohibits telling who adopted a dog to prevent previous owners from harrassing them. i know for a fact that dog was not euthanized, it was a sweet dog, and tena would never put a dog down that doesn't need it. she has adopted most of the pits she gets to people with farms and homes out of town and in arkansas. and another thing, she does not agree with the ordinance, because, like all you people are saying, not all pits are mean, and she has refused to and continues to refuse to euthanize pits that are friendly and not dangerous. why would she let george take that picture if she was going to put it down? she was hoping the picture would get it a good home, and it was adopted before the picture came out. i know you are the person that has been warned about continously calling the pd, and you called today, you will be getting a summons in the mail. have a nice day.

Two Kennett residents are each facing three felony charges following an incident involving animal abuse on Tuesday, Oct. 20.
Jonathan Flood, 23, and Melissa Chester, age unknown, are each facing a Class C felony of burglary in the second degree, a Class D felony of stealing animals, and a Class D felony of animal abuse after an investigation by the Kennett Police Department (KPD) and Kennett Animal Control (KAC).
According to a Probable Cause Affidavit by KPD officer Alan Campbell, on Tuesday, he was approached by a neighbor of Flood's who was carrying a small puppy.
The neighbor said she had observed a pit bull terrier attacking one of two small puppies, and one of them was near death, according to Campbell. The neighbor said she got the other puppy out of the yard and out of harm's way.
Campbell said he then contacted KAC officer Tina Petix to file a report. When Petix arrived at the scene, she, along with the neighbor and Campbell, attempted to contact the residents where the incident took place, but were unsuccessful.
In his report, Campbell said that while they were there, they saw two pit bull terriers and a small black puppy. Campbell said the puppy was bleeding "profusely" from the throat and was shaking uncontrollably, unable to move or walk.
"The puppy's throat had been crushed by the pit bull terrier, a typical form of the pit bull breed," Campbell said in the affidavit.
The officers took possession of the injured puppy and Petix informed Campbell that the puppy was one that had been stolen from the pound earlier that day, Campbell said.
Petix said she had arrived at the pound to find Flood and Chester speaking with another woman and when she approached the three, the woman asked Petix if she could take a dog that she had, Campbell reported. Petix told the woman that she could not take the dog since she lived in the county and the dog was not in the city limits of Kennett.
Campbell said Petix then went back to her truck to do some paperwork and while she was gone, the woman gave her dog to Flood and Chester, who left the pound immediately afterward.
Flood and Chester then returned to the pound, asking Petix if she could take a small black puppy they "found" in the county, Campbell said. Again, Petix said she could not take the puppy because it was not from inside the city limits.
After Flood and Chester left the second time, Petix entered the pound and discovered that a small black and brown puppy that was in the secure part of the pound was missing, Campbell said.
Also in the yard was the small black puppy that Flood and Chester had tried to give Petix earlier that day, according to Campbell.
Campbell said Flood and Chester, advising them to come to the police station. Upon arrival, both individuals were advised of their rights and were charged.
According to Dunklin County Prosecuting Attorney Stephen Sokoloff, Flood and Chester appeared in court on Friday, Oct. 23, and a preliminary hearing was scheduled for Nov. 13, 2009.
Sokoloff said the Class C felony could carry a punishment of 2-7 years in prison and the Class D felonies could carry a punishment of up to four years in prison per felony.
Flood is currently being held on a $50,000 cash only bond. Chester is being held on a $30,000 cash only bond.

I seen this on the news this morning, Jonesboro news at that. Said that Pitbulls can "turn easy". The heck they can! If they are abused early in life, of course they are going to turn. I would turn to. If you raise a pit, like you would raise your child, with rules to follow. Teach them right from wrong. They will be a stand-up dog. Don't teach them anything, of course they are going to be a rebel. Isn't that the way children are too? I had over 8 pitbulls at one time. Beautiful, Loyal, Loving dogs. Often I've seen children poke,or hop on for a ride.And when I felt they might get mad,they've only beamed with pride.I've seen there children yank and pull,with nary a reaction.Yet media's not interested,unless they've put someone in traction.When other dog's have made the news,this breed's name they affix.But when this brave dog saves the day, they call him "boxer mix".They love to snuggle up real close,to give lots of loves and kisses,Yet they suffer more than any,from unfair prejudices.Their tails wag hard and hips twist, too,more so than other mutts.So those of us who know the breed,we call them "wiggle butts".What animal do I speak of,Whose love is so unique? If you've truly known one,you know of whom I speak.There is no creature on this Earth who will ever make you merrier.The animal I do speak of,it's the American Pit Bull Terrier.

maybe organize a rally or a march to the mayors office and demand that you all be heard, if this was going on here I would have no problem getting a good number of citizens involved probably in the hundreds, like I stated above, strength in numbers and theres alotta pitbull lovers out there! and for good reason they are an awsome breed fit for any family I just wish some people would take the time to research instead of making knee jerk decisions that are obviously part of some political agenda or an easy way of irradicating an overpopulated dog breed. PUNISH THE DEED NOT THE BREED.

I don't have pitbulls anymore...I went on vacation and came back, they were all poisoned. All died with in three months of each other. I was just stating that I DO have friends that own pitbulls. And I wouldn't be afraid to take them with me. What are they going to do? They sure aren't going to TAKE them. Nobody is going to do anything, When I go to the city council meeting. You can rest assured I will be the only one there defending this breed.
Why can the step son of a cop have half pitt if no one else is allowed? That is expected in kennett I guess.
I have just wrote Claire McCaskill, Missouri's Senator. So maybe something will happen. Who knows.
If the people falls to appear, have the police pick them up for failure to appear.
I don't understand what the problem is. Kennett is no different than other communities with the same law. Dogs are running lose, what is going to happen when someone gets bit? Then everybody will complain about nothing being done. Its a catch 22, you can't please everybody. Think of the saftey of the citizens of Kennett.
